Starting point only. This draft is written from what this website is set up to do today. Check every part against how your business really works, fill in the parts in [brackets], and have it reviewed (for example by your lawyer or the Motor Trade Association) before you publish. Delete this note when you're done.

This policy explains how Zains Cars collects, uses, keeps and shares personal information through https://zainscars.co.nz, under the Privacy Act 2020.

Who we are

Zains Cars. [Your address].

Our privacy officer: [name], [email].

What we collect, and why

We only ask for what we need to help you buy, sell or finance a car.

  • When you ask about a car or book a test drive: your name, phone number, email address, your message and the day and time you choose, so we can answer you and get the car ready. We may ask to see your driver licence before a test drive.
  • When you offer your car for sale or trade-in: your contact details, the car's plate, make, model, year, kilometres, condition, whether money is owing on it, and the photos you send, so we can value it. The photos are deleted after 90 days.
  • When you ask us to find a car: your contact details and what you are looking for, so we can look for it.
  • When you contact us: the details and messages you send.
  • When you buy a car from us: what the law requires for the sale, such as your name and address on the contract and the change of ownership.

We keep a short summary of each enquiry (who, which car, when) so we can follow it up and keep proper business records.

Who we share it with

We never sell your personal information. We share it only:

  • with services that help us run this website: our website host [name and country], our email provider [name], and Cloudflare, which protects and speeds up the website;
  • with Cloudflare Turnstile, which checks that forms are sent by people, not robots;
  • with Waka Kotahi NZ Transport Agency and other agencies when the law requires it, such as for the change of ownership.

Some of these services store information outside New Zealand. We only use services that protect it in a way comparable to the Privacy Act. [Check where your host and email provider keep data, and name the countries.]

Cookies and website statistics

  • The website uses a few cookies it needs to work, such as keeping a form secure and remembering your light or dark choice.
  • We count which pages are visited, from what kind of device and roughly where, in our own database; nothing is sent to another company for this. We keep your IP address. Visits are deleted after 365 days.
  • Cars you save or compare are kept in your own browser, not sent to us, unless you share the link.

How we keep it safe

Only our staff and the services above can reach your information, through accounts with passwords and two-step sign-in. Finance documents are encrypted. If a privacy breach is likely to cause serious harm, we will tell you and the Privacy Commissioner as the law requires.

How long we keep it

Only as long as we need it for the reasons above, or as long as the law requires for sales and tax records [for example 7 years], then we delete it. Trade-in photos and finance applications are deleted sooner, as described above.

Your rights

You can ask us for the personal information we hold about you, and ask us to correct it. Contact our privacy officer at [email]. We will reply within 20 working days. If you are not happy with how we handled your information, you can complain to the Office of the Privacy Commissioner at privacy.org.nz.
